Petition by Margaret R. Riley for a construction of her husband's Will to determine whether or not she is required to elect
between the provisions made for her in the Will and her legal right to take as a surviving joint tenant. The testator, John
R. Riley, died April 17, 1957 leaving a Will dated June 4, 1953, which was admitted to probate on May 28, 1957 upon petition
of the widow. At the time of his death the testator owned personal property and also owned in joint tenancy with his wife
the home in which they and their daughter, Margaret Louise, lived. By his Will the testator provided his wife and daughter
should jointly have the use and income from his estate, including the home, during the lifetime of his wife or so long as
she did not remarry. In case of necessity the widow has the power to sell the corpus of the estate for the use of herself
and daughter. The interest of the daughter was put in trust and the wife was appointed trustee. Upon the death or remarriage of the testator's widow her interest in the estate terminates, the home passes and becomes a
part of the trust for his daughter, and the balance of the estate, less a bequest to a grandson, is given equally, subject
to a $1,000 adjustment, to his three children, including Margaret Louise, whose share is to be added to her trust.
