Herman A. Uihlein died March 13, 1942 leaving a will executed on November 14, 1941. The residue of his estate was placed in
a trust under the terms of which a stipulated portion of the income was to be paid to the widow and the excess, if any, to
his children. Upon the death of the widow, or on August 17, 1961, whichever should last occur, the trust is to terminate and
distribution of the corpus is to be made in accordance with paragraph 4B(a) of the will which provides as follows: 'At the termination of the trust created by this will, the corpus of my trust estate shall be distributed equally among my
said children then living, and the then living issue, per stirpes, of any deceased child of mine who shall have died either
before or after my death. In the event that prior to the termination of this trust a child of mine shall die without leaving
issue surviving, said deceased child's share in the corpus of this trust estate shall forthwith vest in equal shares in my
children then surviving and the then surviving issue, per stirpes, of any of my children who shall have died prior thereto.'
The judgment entered in the proceedings to settle the estate assigned the residue in the language of the will.
