Action to reopen the matter of the probate of the will of Peter J. Korleski, deceased, commenced by petitioner Harry Korleski, an heir of the deceased, on November 15, 1962. The will had been admitted to probate without objection on July 17, 1962, thirteen days after the death of the testator. In an affidavit in support of his petition to reopen, Harry Korleski alleged that after signing a waiver of notice of hearing at the time the will was read, he became aware of certain facts constituting grounds for objecting to the will on grounds of undue influence and lack of testamentary capacity. A hearing on the petition was had on February 11, 1963, and the petition was denied by order of the county court dated May 2, 1963. The appeal is from the order.
