Proceedings to construe a will. Mary Breese died October 24, 1957, leaving a will which she executed on November 8, 1951. Llewelyn Breese, executor, petitioned the court to determine, among other things, the meaning of the word issue as used in paragraph 6 of the will. The testatrix left her surviving a brother, Llewelyn, approximately 84 years of age, Juliette B. Bennett, also known as Juliette B. Breese, and Leslyn Keie, adopted daughters of her brother William L. Breese, deceased, and a nephew, Robert Evans Breese, son of her deceased brother Rodney Breese. In the will the testatrix bequeathed her household furniture, furnishings, jewelry and personal effects to her surviving brothers, to be divided equally between them. By paragraph 5 she bequeathed her brothers William and Rodney $50,000 each and her brother Llewelyn $60,000. These gifts were to go to the brothers as a class and if the class became extinct in her lifetime the assets were to go according to paragraph 12 of the will.
