This is an appeal by the petitioner Betty Ann Bautista, the former wife of the deceased John K. Massouras from a judgment
decreeing his estate was the owner of certain United States Series E Defense Bonds and, in the event any of the bonds or proceeds
thereof were transferred to the petitioner, she hold such bonds and proceeds in trust for the benefit of his estate. The facts are not in dispute. During their marriage, John K. Massouras and the petitioner acquired in their joint names certain
United States defense bonds having a maturity value of $16,175. On December 6, 1954, a judgment of divorce was granted providing,
pursuant to a stipulation of the parties, the bonds should be divided equally between them. A division of the bonds was made
by the parties and on December 13th, each signed a receipt for the bonds received. Prior to his death on October 25th, 1960,
John K. Massouras cashed in some of his bonds. Included in the assets of his estate were his remaining United States defense
bonds in their original co-ownership form, having an appraised value of $4,425.50. With these bonds, when found in the deceased's
safety deposit box, was a copy of the divorce judgment.
